III. APPOINTMENTS
Form A/ANR
Litchfield Lane
The Board met with Rick Grady of Grady Consulting of Kingston to discuss a Form A/ANR at the corner of Litchfield Lane and Whitman Street. The plan proposes to combine a 2,029 square foot Parcel A with a one-acre parcel located at 1248 Whitman Street which would make Lot 1A on Litchfield Lane a buildable lot. Board members noted that both the Planning Board and Board of Appeals had denied use of a strip along Whitman Street to meet the corner lot requirement relative to equal frontage on both streets. Board members said that the addition of Parcel A to the Whitman Street property would turn it into a corner lot that would also violate the zoning bylaw requirement. Mr. Grady said that he would bring additional information in support of the application to
the next board meeting. His appointment was set for 7:45 p.m. on October 29, 2007.
Form A/ANR
Azalea Way
Board members reviewed a Plan of Land, Azalea Way, dated September 10, 2007, by Robert C. Bailey Co., of Pembroke. The plan transfers Parcel A (482 square feet) and Parcel C (594 square feet) from Michael D. Casey to John Fleming in exchange for Parcel B (1,055 square feet). The exchange is needed, Town Planner Noreen O’Toole explained, because a shed Mr. Casey built on his property is too close to his lot line.

Collamore Estates
Residents
Inspection Report, Merrill Associates
Board members reviewed an October 12, 2007 memorandum from Seth Kruger of Merrill Associates, the Board’s review engineer for Collamore Estates, relative to an October 5, 2007 on-site inspection. In attendance at the inspection in addition to Mr. Kruger were developer William Konish, Planning Board Chairman Philip Lindquist and Araco Sewer Drain Services. A hole was dug in front of 247 Capt. Nathaniel Drive to expose the sub-drain which appeared to be saturated with groundwater. A visual inspection showed that the pipe failed and was crushed. Further inspection with a camera showed failure in the pipe when snaked four and a half feet southerly. It was assumed by all parties involved, Mr. Kruger said, that the sub-drain was failed in
numerous places.
Mr. Kruger recommended that the contractor’s engineer design a sub-drain for the roadway which intercepts groundwater. He suggested that an eight inch perforated HDPE pipe with crushed stone extending approximately five to six feet deep be used in place of the existing drain with the pipe to be connected to the existing catch basin located near the cul-de-sac. It should also be field located and shown on the roadway as-built, Mr. Kruger said. Chairman Lindquist said the existing pipe is very shallow. Town Planner Noreen O’Toole said that she had spoken with Mr. Konish and he was going to have his engineer design an as-built showing the new drainage pipe. That plan will then be reviewed by the Board’s engineer, she said, and hopefully
construction can be completed before winter. She said that she would be talking to Mr. Konish again on Thursday .
Captain Nathaniel Drive resident Judith Lesnik asked who would be responsible for any damage to her driveway and was told any repairs would be the responsibility of Mr. Konish. She said that a portion of her driveway has caved in. Residents said that other areas within the subdivision should be reviewed once the drain issue is resolved. The problems, they said, include cracked curbing and sinking drains. They also asked that the street lights be turned back on and Ms. O’Toole said that she would talk to Mr. Konish about the lights.
IV. NEW BUSINESS
Edgewood Estates
Inspection Report, John W. DeLano and Associates
The Board reviewed an October 5, 2007 inspection report on Edgewood Estates from its review engineer, John DeLano of John W. DeLano and Associates, who was present when William Way was paved. The report indicated that the workmanship and results were acceptable. Board members asked Town Planner Noreen O’Toole to have Mr. DeLano look at the hill that is being removed on one of the lots to see whether it will impact the subdivision in any way.
Hemlock Hills, Phase 2
Inspection Report, Merrill Associates
Board members reviewed October 1 & 5, 2007 inspection reports on the installation of the stormwater infiltration system at Hemlock Hills Estates from its review engineer, Peter Palmieri of Merrill Associates of Hanover.
Massachusetts Federation of Planning and Appeals Boards
Annual Meeting
Board members took home for review a letter from the Massachusetts Federation of Planning and Appeals Boards relative to the organization’s annual meeting to be held on October 27, 2007 in Worcester. Anyone interested in attending will contact the office.
Pine Hill Estates
Inspection Reports
John W. DeLano & Associates, Inc.
Town Planner Noreen O’Toole told the Board that David Blauss from East Washington Street had been to the office to report that, during a recent rainstorm, water from Pine Hill Estates had sheeted across East Washington Street impacting his property.
Board members noted an October 12, 2007 Project Data Report and an October 15, 2007 Telephone Conservation Log from its review engineer, John W. DeLano & Associates confirming the problem. Ms. O’Toole noted that a site visit to discuss possible solutions is scheduled for Wednesday, October 17, 2007 at 9 a.m. with developer Edward Johnson, his engineer, Bernard Munro of Land Planning, Inc., and Mr.DeLano which she plans to attend. Chairman Philip Lindquist said that the road should be crowned to direct water to the side of the road and then into the basins.
V. OLD BUSINESS
Response to Consultant Sid Kashi
Revised Rules and Regulations
Town Planner Noreen O’Toole advised the Board that comments on the most recent draft of the proposed revision to its rules and regulations had been received from Conservation Agent Richard Vacca. Members indicated they were still reviewing the proposed revisions. Chairman Philip Lindquist said there should be a preamble that includes a list of requirements for a filing before the Board.
VI. TOWN PLANNER’S REPORT
Master Plan Committee
Town Planning Noreen O’Toole said that there is a draft copy of the Master Plan in the office, if Board members would like to look at it. A few maps still need to be inserted. The Old Colony Planning Council has put the Hanson Zoning Map on a disc and copies of those are available in the office as well.
Hanson Trails Committee
Ms. O’Toole said that there is nothing new with the Hanson Trails Committee.
Zoning Bylaw Committee
Ms. O’Toole said that the zoning bylaw changes voted at the October 1, 2007 special town meeting have already been sent to the Attorney General’s office for review.
Old Colony Planning Council Joint Transportation Committee
Ms. O’Toole said that the Old Colony Planning Council Joint Transportation Committee met on Thursday October 11, 2007. She said that money is tight for transportation projects.
VII. ZONING BOARD HEARINGS
Application of William Garvey for a special permit to allow for the construction of an in-law apartment within existing single family home at 10 Audubon Lane, Assessors Map 105, Lot 3-7. Property is located in Residence A Zone.
COMMENT: Defer to Board of Appeals
Application of John Skarbinski for a variance to allow the construction of a 10’ x 12’ storage shed that does not meet side setback requirement of 20’ at 38 Ocean Avenue, Assessors Map 2, Lot 1511. Property is located in Residence A Zone.
COMMENT: Defer to Board of Appeals
Application of Dunkin Donuts for site plan approval to allow for an 8’ x 16’ shed for dry storage at 318 Main Street (Hess Gas Station), Assessors Map 40, Lot 42. Property is located in the Business Zone.
